SMCR obligations in a COVID-19 environment
This session will consolidate and comment on the key messages from the FCA in relation to SMCR duties in the current environment. Issues to be considered include temporary arrangements, furloughing SMCR staff and practical tips for dealing with a SIPP’s SMCR population.
Scheme operation and governance during the lockdown
Some practical steps in the current circumstances to keep on top of trustees’ duties and ensure the continued operation and good governance of a SIPP. This session will consider some of the temporary measures that can be used to assist, such as delegation and powers of attorney, and guide you through potential legal pitfalls in order to mitigate future litigation risks arising from the current COVID-19 situation.
Executing documents remotely
Top tips to ensure that pension scheme documents are validly executed when staff are working from home and members are in lockdown. This will include consideration of temporary arrangements for the execution of deeds, the use of e-signatures and the Land Registry requirement for ‘wet’ signatures.
Landlords and rent holidays
SIPP landlords’ rights and remedies when dealing with the non-payment of rent or requests for rent holidays. We will consider the temporary restrictions on the ability of landlords to forfeit commercial leases, other restrictions on possession proceedings brought in as a result of the Coronavirus Act and HMRC’s temporary easements on rent payment holidays.
